This isn't meant as an attack, but is that hard to either not hit anything or accept that(at least on your end) there will be damage if you hit something? I don't think I have the problem at my end( at least never noticed it), but could very well live with damage being always on. At least in singleplayer. I do realize it's not fun when life is harder in MP for you than the rest. Although, again, I could live with that.
And I can't seem to find a definitive answer but have you tried uninstalling the game and deleting each and any trace of savegames/settings/configs? Because at least at the start there was the old PC2 bug where you could drive freshly out of the garage with an already damaged kart after damaging it in an earlier run(with damage off!). What you're seeing could be a left-over from that and be bound to some file still left on your system.

If your are in time trial, then yes, even with damage off, damage is on no matter what in TT.

Yeah... I just always have damage on. I like the consequences. It's can be frustrating on the Nords, but I think that's what brings the AI difficult to more realistic levels. I can run the AI at 120 when damage is off, because I'm braver and aggressive as hell without consequences. Turn damage on and it's a different story. I'm not as aggressive or risk taking, so the AI difficulty has to come down. Same goes for tire wear. If I'm racing less than 30 laps, I'll use accelerated tyre wear. That prevents me from driving as hard/aggressive, and again, forces me to lower the AI.
I agree, it's not always fun in MP, but it's usually not a problem in a decent rated server.
